Welcome to Energies in Motion. These Terms of Use govern your access to and use of energiesinmotion.com, as well as Energies in Motion services, programs, sessions, group offerings, workshops, online events, in-person events, digital materials, audio library content, and related communications.
By using this website, booking a session, registering for a program, attending an event, accessing digital materials, or participating in Energies in Motion offerings, you agree to these Terms of Use.
If you do not agree with these Terms, please do not use this website or participate in Energies in Motion services.
1. Services Provided
Energies in Motion may offer trauma-informed breathwork, somatic release, parts work, soul retrieval, group programs, one-on-one sessions, book clubs, circles, workshops, online events, in-person events, audio resources, and related healing or educational offerings.
Services may be offered online, in person, individually, or in group settings.
2. Age Requirement
Energies in Motion services are intended for adults age 18 and older only. By using this website, registering for services, or participating in any Energies in Motion offering, you confirm that you are at least 18 years old.
3. Not Medical, Mental Health, or Emergency Care
Energies in Motion does not provide medical care, psychotherapy, psychiatric treatment, diagnosis, crisis intervention, emergency services, or licensed mental health treatment.
Services offered by Energies in Motion are not a substitute for professional medical care, mental health counseling, psychotherapy, psychiatric support, trauma therapy, medication, diagnosis, or treatment from a licensed provider.
Nothing on this website or in any Energies in Motion service should be interpreted as medical advice, mental health advice, diagnosis, treatment, or a promise of healing.
If you have a medical condition, mental health condition, trauma history, psychiatric concern, physical limitation, pregnancy-related concern, breathing-related condition, or any question about whether breathwork, somatic practices, emotional processing, or related services are appropriate for you, you are responsible for consulting with a qualified medical or mental health professional before participating.
4. Emergency and Crisis Disclaimer
Energies in Motion is not an emergency service or crisis support provider.
If you are experiencing a medical emergency, mental health emergency, suicidal thoughts, thoughts of harming yourself or others, domestic violence crisis, abuse, or any immediate danger, call emergency services or contact a qualified crisis support resource immediately.
Do not use Energies in Motion services, emails, forms, sessions, or website communications for emergency support.
5. Client Responsibility and Assumption of Risk
By participating in Energies in Motion services, you acknowledge that breathwork, somatic release, trauma-informed practices, parts work, soul retrieval, meditation, reflection, group sharing, and related practices may involve emotional, physical, energetic, psychological, or spiritual experiences.
These experiences may bring up memories, sensations, emotions, personal insights, discomfort, grief, anger, fatigue, vulnerability, or other responses.
You are responsible for deciding whether participation is appropriate for you. You agree to listen to your body, honor your boundaries, pause or stop participation when needed, and seek professional support when appropriate.
You acknowledge that results vary and that Energies in Motion does not guarantee any specific outcome, transformation, healing result, emotional change, physical improvement, spiritual experience, or personal result.
6. Participation in Group Offerings
Energies in Motion may offer group programs, circles, workshops, book clubs, online events, and in-person events. Group spaces are intended to be respectful, trauma-informed, and supportive.
By participating in a group offering, you agree to:

• Respect the privacy and dignity of other participants

• Not share another participant’s personal story, identity, comments, or experiences outside the group

• Communicate respectfully

• Avoid harassment, discrimination, abusive language, threats, or disruptive behavior

• Participate within your own capacity and boundaries

• Understand that group offerings are not therapy or crisis support

Energies in Motion reserves the right to remove a participant from a session, program, event, group, or community if their behavior is harmful, disruptive, unsafe, inappropriate, or inconsistent with the purpose of the offering. Removal does not guarantee a refund.
7. Confidentiality in Sessions and Groups
Energies in Motion respects client privacy and asks all participants to do the same. However, Energies in Motion cannot guarantee confidentiality in group settings because other participants are present.
In individual sessions, Energies in Motion will make reasonable efforts to respect the privacy of information shared. However, confidentiality may be limited when disclosure is required by law, necessary to prevent harm, required for legal compliance, or necessary to protect safety.
8. Scheduling, Attendance, Late Arrivals, and No-Shows
You are responsible for attending sessions, programs, events, and appointments at the scheduled time.
If you are late to a session, the session may still end at the originally scheduled time.
If you are more than 10 minutes late without notice or contact, the session may be considered a no-show.
No-shows may be eligible for rescheduling only according to the Energies in Motion Refund and Rescheduling Policy. No-shows are not eligible for refunds.
9. Payment and Payment Plans
Payment is required according to the terms provided at the time of booking, registration, invoice, checkout, or written agreement.
Energies in Motion may offer payment plans by prior agreement with the client. If a payment plan has been established, the client remains responsible for completing the agreed payment plan even if the client stops attending, stops participating, misses sessions, or chooses not to complete the program or service.
Failure to complete agreed payments may result in loss of access to sessions, programs, events, digital materials, audio library content, or future services.
10. No Refunds
All purchases, payments, deposits, program fees, event registrations, session fees, payment plan payments, and digital content purchases are non-refundable unless otherwise required by law.

11. Audio Library and Digital Content
Energies in Motion may provide access to audio library content, recordings, meditations, educational materials, worksheets, written content, downloads, or other digital resources.
All digital content is owned by Energies in Motion or used with permission. Access is granted for personal, individual use only.
You may not:

• Share your login or access with others

• Copy, record, download, reproduce, publish, distribute, sell, upload, transmit, or otherwise share Energies in Motion materials without permission

• Use Energies in Motion content for your own business, teaching, group, course, public event, or commercial purpose

• Modify or create derivative works from Energies in Motion materials without written permission

Unauthorized sharing or use may result in termination of access without refund and may be subject to legal action.
12. Intellectual Property
All website content, written materials, audio content, recordings, meditations, program materials, branding, logos, text, images, videos, downloads, frameworks, and other materials provided by Energies in Motion are the property of Energies in Motion or its content providers unless otherwise stated.
You may not copy, reproduce, republish, distribute, display, sell, or use Energies in Motion intellectual property without prior written permission.
13. Website Use
You agree not to use the Energies in Motion website or services to:

• Violate any law or regulation

• Harass, harm, threaten, or abuse others

• Submit false, misleading, or harmful information

• Attempt to access private systems, accounts, or data

• Interfere with the website or services

• Upload viruses, malicious code, spam, or harmful content

• Copy or misuse website content

Energies in Motion reserves the right to restrict or terminate access to the website or services if these Terms are violated.
14. Third-Party Platforms
Energies in Motion may use third-party platforms, including but not limited to Zoom for online sessions and Gmail for certain communications.
Third-party platforms have their own privacy policies, security practices, and terms. Energies in Motion is not responsible for the actions, outages, security, privacy practices, or policies of third-party providers.
15. Testimonials and Results
Testimonials, stories, examples, or client experiences shared on the website or in Energies in Motion materials are individual experiences. They do not guarantee that you will have the same or similar results.
Healing, personal growth, emotional processing, and spiritual experiences vary from person to person.
16. Limitation of Liability
To the fullest extent permitted by law, Energies in Motion is not liable for any direct, indirect, incidental, consequential, special, emotional, physical, financial, or other damages arising from your use of the website, participation in services, reliance on content, inability to access services, or participation in sessions, programs, events, or digital offerings.
You agree that participation is voluntary and that you are responsible for your own choices, wellbeing, support systems, and professional care.
17. Indemnification
You agree to hold harmless and indemnify Energies in Motion, its owner, representatives, contractors, and affiliates from claims, damages, losses, liabilities, costs, or expenses arising from your use of the website, participation in services, violation of these Terms, misuse of materials, or infringement of another person’s rights.
18. Right to Refuse Service
Energies in Motion reserves the right to refuse, discontinue, or limit services at its discretion, including when services are not appropriate for a client’s needs, when safety concerns arise, when boundaries are violated, when payment terms are not met, or when a participant behaves in a harmful or disruptive manner.
19. Governing Law
These Terms of Use are governed by the laws of the State of Tennessee, without regard to conflict of law principles.
20. Changes to These Terms
Energies in Motion may update these Terms of Use from time to time. Updates will be posted on this page with a revised effective date. Continued use of the website or services after updates are posted means you accept the revised Terms.
